Welcome to Touristas!

These Terms and Conditions (“Terms”) govern your use of the Touristas mobile application (the “App”) and any related services (collectively, the “Services”) provided by Touristas (“we,” “us,” or “our”), a business based in Budapest, Hungary.

By creating an account, accessing, or using our App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

 

1. Our Services

Touristas provides a mobile application that offers self-guided audio tours for various locations. To access the tours for a specific city, you must purchase a “City Pass,” which grants you access to all available tours within that city for a one-week period.

Our Services utilize GPS technology to provide location-based audio content. The App is currently available for Budapest, with plans to expand to other cities in the future.

 

2. Account Creation and Responsibilities

  • Eligibility: You must be at least 16 years old to create an account and use our Services.

  • Account Information: You must provide a valid email address and create a password to sign up. You are responsible for providing accurate and complete information and for keeping your account details up to date.

  • Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately at support@touristas.net of any unauthorized use of your account.

3. City Pass, Payments, and Refunds

  • City Pass: To access the audio tours in a city, you must purchase a City Pass. The pass provides unlimited access to all tours within the selected city for a period of one (1) week (168 hours) from the time of purchase.

  • Payment: We use Stripe, a third-party payment processor, to handle all transactions. By making a purchase, you agree to Stripe’s terms of service and privacy policy. We do not store or have access to your full credit card details.

  • Pricing: Prices for City Passes will be displayed in the App at the time of purchase. We reserve the right to change prices at any time.

  • Refunds: Due to the digital nature of our content, purchases of City Passes are final and non-refundable, except where required by law. If you experience technical issues that prevent you from using the App, please contact us at support@touristas.net for assistance.

 

4. License to Use the App

  • Grant of License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Touristas App for your personal, non-commercial use in accordance with these Terms.

  • Restrictions: You agree not to:

    • Copy, modify, distribute, sell, or lease any part of our Services or included software.

    • Reverse engineer or attempt to extract the source code of the App.

    • Use the Services for any commercial purpose or for the benefit of any third party.

    • Interfere with or disrupt the integrity or performance of the Services.

    • Use the Services in any way that violates any applicable local, national, or international law.

 

5. Intellectual Property

All content provided through the Services, including the audio tours, text, graphics, logos, and software, is the exclusive property of Touristas and its licensors. This content is protected by copyright and other intellectual property laws. Your purchase of a City Pass grants you access to this content, not ownership of it.

 

6. Third-Party Services

Our Services integrate with and rely on third-party services. Your use of our App is also subject to their respective terms and conditions and privacy policies:

  • Audio Generation: Google Cloud TTS / AWS Polly

  • Payment Processing: Stripe

  • Mapping and Directions: Google Maps / Mapbox

We are not responsible for the operation, content, or policies of these third-party services.

 

7. Disclaimers

  • “As Is” Service: The Services are provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure.

  • Location Accuracy: The App relies on GPS and mapping services. We are not responsible for the accuracy of GPS data or maps provided by third-party services.

  • Safety: You are responsible for your own safety while using our audio tours. Always be aware of your surroundings, follow traffic rules, and exercise caution. Do not let the App distract you from potential hazards. Touristas is not liable for any personal injury or property damage that may occur while you are using the Services.

 

8. Limitation of Liability

To the fullest extent permitted by applicable law, Touristas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • (a) your access to or use of or inability to access or use the Services;

  • (b) any conduct or content of any third party on the Services; or

  • (c) unauthorized access, use, or alteration of your transmissions or content.

In no event shall Touristas’ aggregate liability exceed the amount you paid us for the City Pass in the last six months.

 

9. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately. You can terminate your account at any time by contacting us at support@touristas.net.

 

10. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall be resolved through amicable negotiations. If a resolution cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the competent courts in Budapest, Hungary.

For consumers within the European Union, you may also be entitled to use the EU’s online dispute resolution platform, which can be accessed at http://ec.europa.eu/odr.

 

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the new Terms within the App and updating the “Last Updated” date. Your continued use of the Services after any such change constitutes your acceptance of the new Terms.
